These Terms of Service govern the provision of wedding videography and film services by Miette & Films Wedding Pty Ltd (ABN ABN 91 702 532 161), located in Melbourne VIC, and accessible at https://miettefilmsweddingtec.online. By engaging our services or using this website, you agree to these terms.

1. Services

We provide wedding videography and film services, including coverage of ceremonies and receptions, editing, colour grading, and delivery of finished films as described in your written booking agreement or quotation.

2. Bookings and Confirmation

A booking is confirmed only upon receipt of a signed agreement and the required booking deposit. Dates are reserved on a first-confirmed basis, and we cannot hold dates without a confirmed booking.

3. Deposits and Payment

A non-refundable deposit is required to secure your wedding date. The remaining balance is due no later than fourteen (14) days before the event date unless otherwise agreed in writing. Late payments may result in delayed delivery of your finished films.

4. Cancellation and Rescheduling

If you cancel your booking, the deposit is non-refundable. If you reschedule, we will endeavour to accommodate your new date subject to availability. If we must cancel for reasons within our control, all payments made will be refunded in full.

5. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation. Our services come with guarantees that cannot be excluded under Australian Consumer Law, including guarantees that services will be rendered with due care and skill.

6. Creative Licence

Our videographers exercise reasonable creative and editorial discretion in filming and editing. While we work to your brief, the final artistic interpretation of your wedding film rests with Miette & Films Wedding Pty Ltd.

7. Delivery of Films

Indicative delivery timeframes are provided in your booking agreement. Timeframes may vary during peak wedding season, and we will notify you of any significant delays.

8. Copyright and Usage

Copyright in the films remains with Miette & Films Wedding Pty Ltd. You receive a personal, non-commercial licence to use, share and view your wedding films for private purposes. We may use excerpts of your films for portfolio and promotional purposes unless you request otherwise in writing prior to your wedding date.

9. Image and Footage Capture

Filming outcomes depend on factors outside our control, including venue restrictions, lighting, weather, and guest behaviour. While we take all reasonable care, we cannot guarantee specific shots or moments.

10. Liability

To the extent permitted by law, our liability for any claim arising from our services is limited to the total fees paid by you. We are not liable for indirect or consequential losses. We maintain professional insurance for our equipment and operations.

11. Backup and Archival

We take reasonable steps to back up footage during production. We recommend you maintain your own copies of delivered films, as archived footage may be deleted after twelve (12) months.

12. Website Use

Content on this website is provided for general information. You may not reproduce, copy or distribute website content without our prior written consent.

13. Privacy

Our collection and handling of your personal information is described in our Privacy Policy.

14. Governing Law

These terms are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts of Victoria.
